their case on monday. for the past few weeks... defense attorneys have argued that jose garcia zarate accidentally shot kate steinle on pier 14 in july of 2015 when she was walking with her dad they said he picked up the gun... and it accidentally went off... even bringing in their own experts who claim the bullet ricocheted off the pier and hit steinle prosecutors have not presented a motive why they think garcia zarate shot steinle to justify their murder charge. there is an end in sight as closing arguments are set to begin on november 20th ( james ) ( james ) in the east

( darya ) in the north bay... police arrest a man with a gun near a middle school. police say the gun was not loaded. it happened at hall middle school in larkspur. district officials called police to report a man on campus who was not supposed to be there. police tracked the man down and found the gun in his backpack. there was no ammunition and the man was arrested and booked on charges of having a gun on school grounds. police say this

case is not related to the recent shooting threats at redwood high school. ( darya ) happening now... police are looking for the man who robbed a bank in brentwood. it happened at the bank of agriculture and commerce on first street. a man walked into the bank with a gun... demanded the money and took off. he was last seen running on first street towards diablo alley. nobody was injured in the robbery.not have a description of the thief. ( james ) san francisco... has suspended the entertainment permit of an excelsior district bar... where a deadly shooting happened in may. the suspension will last 30 days at the request of the district supervisor. la oficina...located on missions street... was the scene of a shooting that killed 30-year- old alvaro palma. security guard david sanches ...was arrested and charged for the shooting. he is still behind bars this morning with bail set at 10 million dollars. ( james ) in the south bay... a family has filed a civil rights lawsuit against the city of santa clara after a man was shot and killed by an officer. police have

released the body camera footage from the night of the shooting. it happened back on march 9th. according to the district attorney's investigation... jesus geney- montez charged toward the officer with his hand up. the d-a's office says that the officer had reason to use force. the officer originaly said that he thought that geney-montez was armed. it turned out he was not. the video also appears to show a fence between geney-montez and the officer. ( james ) the family has also filed a lawsuit against the officer. santa clara police said they agree with the d-a's findings. back to you. ( darya ) in the south bay... 12 people are without a home this morning .... including three children... after a fire broke out at a townhouse in

san jose. it happened yesterday morning... on don seville court. people in the townhouse had already evacuated the buildings by the time firefighters got there. fire crews were able to put out the blaze about an hour later. no one was injured in the fire... ( darya ) the california public utilites commission has now ordered utility companies to give special protections to customers affected by the north bay firestorm. the c-p-u-c made the orders based on recommendations developed by its staff. communication companies now have to refund their customers during the times their area was devastated by the fire. water companies have to help fire victims resolve unpaid bills. p-g-and-e has also been ordered to waive some costs to fire victims. ( james ) happening today... a family who was the victim of a mobile home fire in san jose will get a new home. back in august a fire at the golden wheel mobile home park in san jose killed a man and two young girls. a week after the fire.. two people agreed to

buy a new mobile home for the family. today the family will be welcomed back into that home. ( james ) happening now: danville police are are looking for these three people connected to a car burglary. the burglary happened back on october 20th in the fountain springs area of danville. police have just released this image. the three were last seen last on surveillance video walking into a nordstrom rack in concord. car enthusiasts are doing something about it in san jose. ( james ) will tran is here with the details.

( will ) in the south bay... a group of car enthusiasts in the south bay say they are tired of the sideshows in san jose. they claim because of the sideshows....... all car groups are being targeted by police. now they are taking matters into their own hands. different car groups have come together to form a bay area alliance to tackle the problem. the new alliance says they plan on working with police to track down people responsible for the sideshows. ( james )

( james ) happening today... people all across the bay area can rent a "ford go bike" for free. all day long... can take a bike from bike stations all across the bay area and return them to another station. the stations are spread all across san francisco... san jose and parts of the east bay. ( james ) two bay area colleges top the list for people who make the most money after graduation. and the top school on the list is not one that you would expect. samuel merritt university in oakland came in at number one. the study found that 10 years after graduating former students made an average of more than 106-thousand dollars. stanford came in at number 2 on the list. graduates there made just over 85-thousand dollars. also in the top 5 were two southern california schools and the

california state maritime university... which is located near vallejo. santa clara university was number ten on the list. the study only included students who had federal student loans. ( darya ) the next time you go to the grocery store... make sure you wipe down the shopping cart. police say it could save your life... but it is not because of the germs. police say drugs like fentanyl an be on the cart and enter your system just by touching your hands. a florida police department issued the warning after a 10-year-old boy in miami died after coming into contact with the drug on a shopping cart. other police departments across the country say the odds of this happening are very slim.. but it is better to be safe than sorry. ( darya ) amazon plans to sell more of its products at whole foods. the online retailer has announced it will start selling its kindles, fire tablets and other amazon

( james ) the national archives is releasing more than 13- thousand records related to the 1963 assassination of president john f. kennedy... the release of kennedy records is the fourth so far this year. last month president trump directed agenices involved to review each of their redactions during the next 180- days. he said the agency heads need

to be extremely cautious in recommending that any of that information still needed to be withheld from the public. government agencies now have until march to tell the national archives why any part of kennedy's records should be censored. the john f. kennedy collection contains about five- million pages of records. ( darya ) a warning for parents a warning ( darya ) a warning for parents this morning... after a new study reveals high levels of lead .. in 'fidget spinners'.( james ) the non-profit group- the cal-p-i-r-g education fund... tested two 'fidget spinners' sold at target stores. this is one of them.( darya ) their lab results showed... the products contained lead levels more than 3- hundred times higher than the federal limit. the group says, it alerted target and the toy's manufacturer-- bull's eye toy.( james ) the groups

says that both responded by saying a 'fidget spinner' is technically 'not' a children's toy ... and therefore not subject to legal limits for lead. they cited the consumer product safety commission ... which reiterated that 'fidget spinners' are not classified as toys. ( darya ) tap water is being tested for lead at all schools in the oakland unified district.( james ) the testing kicked off at five schools where lead contamination was found. will tran is here with the details. ( will ) more schools are going to begin testing tap water for lead. schools in richmond will begin testing water next week. east bay mud spent the day yesterday testing water at schools in oakland. at least 7 schools in oakland tested positive for lead earlier this year. the school district says the problem has been fixed but they are having the water tested just to be safe. east bay mud is now offering to test the water at all school in their service area. ( james ) also in the also in the east bay... a man died after he was found lying in the middle of

the street in union city... it happened yesterday morning near the corner of allison and lisa drives. officers performed c-p-r... but the man died at the scene. police believe the victim may have been involved in a dispute with family members before they were called. police have not yet released the cause of death... and it is unknown whether foul play is involved. ( darya ) in the south bay... a man is arrested... accused of inappropriately touching a student at san jose state university. it happened yesterday.... inside the m-l-k library.inside the m-l-k library. police identified the suspect as javiar coreas. the victim was not physically injured. university police are investigating the incident... and are currently looking for potential witnesses. ( darya ) happening now in the north bay... police in novato are investigating a death that they are calling suspicious. the investigation started

yesterday afternoon on holstrom circle. they have not released any other information on the victim or the investigation. they do ánot believe that there is a current threat to the community. ( darya ) and police in the south bay are investigating an armed robbery at a gas station. the thief is still on the loose. it happened the gas station on saratoga avenue and bucknell road in saratoga. police say the thief showed the clerk a gun. it is not clear what the thief took. the person was last seen on bucknell road getting into a silver honda with no license plates. ( james ) another lawsuit has been filed against p-g- and-e in connection to the deadly north bay fire storm. the lawsuit was filed in san francisco for the family of a couple who died in the wildfire in mendocino county. the suit claims the p-g-and e failed to maintain equipment and that may have sparked the fire. so far 17 people have filed lawsuits against p-g-and-e for the fires. investigators have not determined what caused the fires. 43 people died in the fires... 23 of them were in sonoma county. ( darya ) there is some good news for students of one school that was seriously damaged by the fires. the cardinal newman high school

football team is headed to the playoffs. several players on the team lost their homes in the north bay firestorm. and the school was badly damaged. on newman's campus...an enormous chain linked fence blocks out students and staff from certain parts of campus. practice now takes place at a nearby high school. students are attending classes at several other schools in the community. the time table for when these players will share classes again... is uncertain . but they're all together when it comes to football. ( james ) california regulators have officially decided uber and lyft do not have to fingerprint their drivers as part of their background checks. the utilities commission made the rule official during a meeting in san francisco. the taxi industry had been pushing for uber and lyft drivers to be fingerprinted because it's required for taxi drivers. the commission reviewed the case for a year... and says that fingerprinting does not add a greater level of safety. people in the taxi industry are calling the decision a mistake. ( james ) meanwhile... uber says it will appeal a u-k decision that would give drivers rights -- like guaranteed minimum wage and holiday pay. uber argued that their drivers were self- employed... and they choose when and where they drive. two drivers in the u-k sued the san francisco-based company over their pay. their lawyers argued uber

( darya ) having more girls in a classroom can make boys smarter. the reason? it motivates them to do better. researchers have found in schools that have more then 60 percent girls, test scores were significantly higher.

filed against p-g-and-e in connection to the deadly north bay fire storm. the lawsuit was filed in san francisco for the family of a couple who died in the wildfire in mendocino county. the suit claims the p-g-and e failed to maintain equipment and that may have sparked the fire. so far 17 people have filed lawsuits against p-g-and-e for the fires. investigators have not determined what caused the fires. 43 people died in the fires... 23 of them were in sonoma ( james ) in the east bay... a man died after he was

( james ) santa clara county has approved a proposal to build a mental health facility for kids. it will be built at valley medical center in san jose. the county board of supervisors says they had the support of

( darya ) california regulators have officially decided uber and lyft do not have to fingerprint their drivers as part of their background checks. the utilities commission made the rule official during a meeting in san francisco. the taxi industry had been pushing for uber and lyft drivers to be fingerprinted because it's required for taxi drivers. the commission reviewed the case for a year... and says that fingerprinting does not add a greater level of safety. people in the taxi industry are calling the decision a mistake. ( darya ) happening now... police are looking for the man who robbed a bank in brentwood. it happened at the bank of agriculture and commerce on first street. a man walked into the bank with a gun... demanded the money and took off. he was last seen running on first street towards diablo alley. nobody was injured in the robbery. police do not have a detailed description of the thief. ( james ) san francisco... has suspended the entertainment permit of an excelsior district bar... where a deadly shooting happened in may. the suspension will last 30 days at the request of the district supervisor. la oficina...located on missions

( james ) in the south bay... a family has filed a civil rights lawsuit against the city of santa clara after a man was shot and killed by an officer. police have released the body camera footage from the night of the shooting. it happened back on march 9th. according to the district attorney's investigation... jesus geney- montez charged toward the officer with his hand up. the d-a's office says that the officer had reason to use force. the officer originaly said that he thought that geney-montez was armed. it turned out he was not. the video also appears to show a fence between geney-montez and the officer.

( darya ) the california public utilites commission has now ordered utility companies to give special protections to customers affected by the north bay firestorm. the c-p-u-c made the orders based on recommendations developed by its staff. communication companies now have to refund their customers during the times their area was devastated by the fire. water companies have to help fire victims resolve unpaid bills. p-g-and-e has also been ordered to waive some costs to fire victims. ( james ) its been a busy week in the nation's capitol with taxes dominating the conversation.( darya ) kron's political correspondent alexandra limon joins us live from washington to talk about tax reform. alex the senate's version of the bill was released yesterday how is it different from the house version? (alex) the senate bill is quite different from the house bill and it will be interesting to see if both houses can come to an agreement because the bills are so different for

( james ) also in the east bay... a man died after he was found lying in the middle of the street in union city... it happened yesterday morning near the corner of allison and lisa drives. officers performed c-p-r... but the man died at the scene. police believe the victim may have been involved in a dispute with family members before they were called. police have not yet released the cause of death... and it is unknown whether foul play is involved. ( darya ) in the south bay... a man is arrested... accused of inappropriately touching a student at san jose state university. it happened yesterday.... inside the m-l-k library. police identified the suspect as javiar coreas. the victim was not physically injured. university police are investigating the incident...

( darya ) happening now in the north bay... police in novato are investigating a death that they are calling suspicious. the investigation started yesterday afternoon on holstrom circle. they have not released any other information on the victim or the investigation. they do ánot believe that there is a current threat to the community. ( darya ) and police in the south bay are investigating an armed robbery at a gas station. the thief is still on the loose. it happened the gas station on saratoga avenue and bucknell road in saratoga. police say the thief showed the clerk a gun. it is not clear what the thief took. the person was last seen on bucknell road getting into a silver honda with no license plates. ( james ) santa clara county has approved a proposal to build a mental health facility for kids. it will be built at valley medical center in san jose. the county board of supervisors says they had the support of more than two dozen parents and educators. according to one supervisor... nearly 20

children per day are hospitalized in santa clara county because of psychiatric emergencies. there is no word on when the facility will open. the board still has to approve the construction plans. that process could take up to six months. ( james ) another lawsuit has been filed against p-g- and-e in connection to the deadly north bay fire storm. the lawsuit was filed in san francisco for the family of a couple who died in the wildfire in mendocino county. the suit claims the p-g-and e failed to maintain equipment and that may have sparked the fire. so far 17 people have filed lawsuits against p-g-and-e for the fires. investigators have not determined what caused the fires. 43 people died in the fires... 23 of them were in sonoma county. ( darya ) there is some good news for students of one school that was seriously damaged by the fires. the cardinal newman high school football team is headed to the playoffs. several players on the team lost their homes in the north bay firestorm.

and the school was badly damaged. on newman's campus...an enormous chain linked fence blocks out students and staff from certain parts of campus. practice now takes place at a nearby high school. students are attending classes at several other schools in the community. the time table for when these players will share classes again... is uncertain . but they're all together when it comes to football. ( james ) california regulators have officially decided uber and lyft do not have to fingerprint their drivers as part of their background checks. the utilities commission made the rule official during a meeting in san francisco. the taxi industry had been pushing for

uber and lyft drivers to be fingerprinted because it's required for taxi drivers. the commission reviewed the case for a year... and says that fingerprinting does not add a greater level of safety. people in the taxi industry are calling the decision a mistake. ( james ) a youth outreach program in oakland is now being recognized for its efforts.( darya ) the destiny arts youth performance company received a national award. the group aims to inspire and create social change through performing arts. it was among dozens of groups across the country ... that received the national arts and humanities youth program award. that is the highest honor for programs of this type. the group has been working with young people in oakland for 25 years.
