>> chris: we're going to fix that microphone for you. right now it is 6:01 and we take you inside a developing story. a panel is shot in a drive by shooting in our own backyard and police are trying to figure out what went down. kendall is at the location where the man was last seen alive. >> good morning. a lot of unanswered the 48-year-old man left the bar here around 4:00 yesterday morning. the other people at the bar say when he left he was completely unharmed. he left driving towards anthem. he called police saying he had been shot. michelle french said beyond that is driver was unable to offer any useful information.

they say this is going to be a life threatening event when it comes to rain, storm surge and wind. guests here are being asked to make arrangements as soon as possible if they want to get out. this resort is 20 stories high. we are on the 17th floor. they tell us in the case of an evacuation they would move all guests to the convention center which is a short walk from the resort itself. officials are keeping a close eye on hurricane matthew. but hoping that the damage left behind is not severe. >> tom: we have sky 3 in route to a reported accident up in the far northeast valley. we're not there yet so we're making our way. even from here we can see flashing lights. this is way out on i15 looks

before it made land fall this morning already in haiti. obviously the storm potentially caused catastrophic damage when you consider the living situation, they had to deal with that earthquake several years ago. packing 145-mile an hour winds that could drop up to three feet of rain. once it's done with this, it's going to move on to the eastern coast of cuba. here is what we're looking at. from hurricane matthew. you see the eye making land fall in haiti. it's going to make another land fall in the eastern tip of cuba here before moving into the bahamas. here is the forecast cone for this storm. hugging the coast of the united states. category three storm potentially hugging the coast of florida. this will be on friday.

look at hurricane matthew. >> dana: it's a local case that made a lot of headlines in our community. the former head of an animal sheller in boulder city insists she is not guilty of felony animal abuse. craig joins us live from downtown las vegas. and the big question is will she or won't she appear in court this morning? >> that is one of the questions. she had been leading the boulder city animal shelter for 18 years. then in april of 2015 allegat numerous pets to be euthanized before the required waiting time for the pets to be adopted. she was indicted by a grand jury in connection with this case and faces two felony counts in connection with the crimes she's alleged of committing, needlessly euthanizing more than 90 animals anyway single year. in september the case was set for trial but that date was

we may learn whether or not they are going to choose to go to trial or the possibility this case will be set untilled some type of a plea deal. it's on calendar for 8:30 this morning. it generated a lot of emotion when it made headlines. i'll be in court to find out if we're looking toward a resolution today. she faced a maximum of two years in prison, minimum of two years in prison, a m the loud noise you are hearing is construction, jackhammering and saw cutting of concrete around the corner. it's very busy outside the court. i have to point that out in case you are wondering what you are hearing. >> kim: craig with amazing concentration, thank you. >> dana: i thought that was a jackhammer. a house fire near downtown las

a half ago near stewart and sloan. the home was abandoned but neighbors say squatters were living there. >> chris: some rape victims could be closer to getting the justice they deserve. we're talking about the rape kits gone untested. some have recently been tested and 42 of them got positive hits. we just learned this yesterday. that means the hits within the data base, attackers havin the next step could be criminal charges once they track the people down. those kits became an issue in this election season. she has gone on the record saying that the backlog was due to a lack of funding and that is
