a deadly new year's eve in the bay area. new details at a crash that killed a mother and injured her baby. marking five years since the shooting death of oscar grant on the platform of the fruitvale b.a.r.t. station. the event getting underway. new laws are in effect across the country. one had people lining up for hours overnight.

it's been a deadly holiday. we're learning more about one of several crashes that took place on bay area roads. brian flores is live at the scene of a crash that killed one young mother. >> reporter: good afternoon. it's been a deadly day on the roadways on this new year's eve and new year's day here in fremont. a 19-year-old woman is dead and her 3-month-old baby is clinging to life. she just spoke to the aunt of that girl of that woman and she's obviously devastated. this happened before 10:00 last night. according to police, the woman who family members have also identified as ashley, her 3- month-old baby and her 17-year- old sister, rena, were hit as they were crossing the street here. police tell me this was -- there was some type of argument in the car involving the sisters and another relative that was in the car. police say the argument got so heated toward the driver of the car and he stopped at paseo

padre parkway and mowry road. the sisters got out of the car and took out the 3-month-old boy. moments later, a 64-year-old driver in a truck hit all three. we just spoke to the aunt of the 19-year-old and she says the family is heartbroken. >> devastated. just devastated. i just can't believe this, this happened to us, you know. good girl, good mother. i'm not saying it because people say nice things when people die but, yeah, good mother, good heart. it's -- this is terrible for her mother and father and brothers and sisters. >> reporter: now, police say that driver has not been charged but is cooperating with the investigation and it does not appear that alcohol or drugs were a factor. police also say the sisters were not walking in the crosswalk at the time. at this noon hour, the baby is at oakland children's hospital with life-threatening injuries.

19-year-old ashley died from her injuries earlier this morning and rena is at kaiser in fremont with non-life- threatening injuries. but the family says she has several broken bones and may have a broken leg. according to family members, they were on their way home last night and do plan on having a vigil tonight here at 6:00 at the intersection here in fremont. we're live here in fremont, brian flores, ktvu channel 2 news. >> all right. thank you, brian. also on new year's eve, a 7- year-old girl was hit and killed by a car as she crossed a san francisco street. mum at 12:-- coming up at 12:15, what witnesses heard the driver say after the crash. a suspected drunk driver crashed into several cars in lay ward leaving behind a long path of destruction. it happened around 5:30 on grove way near western boulevard. the highway patrol says the driver was speeding over railroad tracks when his car went airborne. the vehicle knocked over a sign, hit fences and damaged

parked cars before landing on top of a classic 1964 mustang. >> the driver was in the back seat of the car. >> reporter: so he didn't have his seat belt on? >> no. >> reporter: and i understand he had a bloody nose? >> yes, kind of out of it. you could smell alcohol. he was drunk. he said he wasn't drunk but you could tell he was drunk. >> drunk. >> officers say the driver was taken to the hospital. no one else was hurt. the driver facing drunk driving charges. happening now -- it's been five years since oscar grant was fatally shot on a b.a.r.t. station platform. today, family and supporters are celebrating his life. ktvu's rob roth is live at the fruitvale b.a.r.t. station with the event just getting underway. good afternoon, rob. >> reporter: good afternoon, tori. well, the memorial for oscar grant should be getting underway any minute now. people are -- have started to gather, they are beginning to set up and they've brought signs at the fruitvale b.a.r.t. station. last year, the memorial drew

several hundred people. this year's theme is peace is the answer, put the guns down, what about our children? and this is dead gated to every mother who has lost a child to gun violence. >> this says your death was not in vain. we're gonna try to build a situation that prevents more of what's going on here. you know, killing for no reason at all. >> reporter: it was new year's day morning five years ago today and was captured on cell phone video. bart police officers detained grant. grant was lying on the platform in police custody when johannes mehserle shot him in the back. johannes mehserle said he only meant to tase him. this drew the catchphrase we are all oscar grant. grant is the subject of a critically acclaimed movie last year called "fruitvale

station." the crew members and cast members are expected to attend and so are grant's mother and uncle. the vigil is expected to start very soon and is expected to run until about 4:00 this afternoon. reporting live here in oakland, rob roth, ktvu channel 2 news. >> all right. thank you, rob. we've now learned that a shooting in oakland in the final hours of 2013 claimed the life of a 13-year-old boy. investigators say the teen was walking home from a recreation center when he was shot several times. it happened around 9:30 p.m. near the intersection of 104th avenue and walnut creek street -- wul nut street. the boy died early this morning at highland hospital. this was oakland's first homicide of 2014. police don't have a motive for the shooting and no arrests have been made. oakland police are investigating a shooting that left one woman dead in the san antonio neighborhood. investigators say 21-year-old ashley walker was sitting in a car with friends when someone opened fire on them. it happened on the 2,000 block

of 22nd avenue. friends took her to the hospital where she died. this marked oakland's 92nd homicide of 2013. no arrests have been made. a number of new gun control laws hit the books today. one law requires the state to collect specific information about shot gun and rifle purchases. that information would then be stored on a comur -- computer database. in the past only handgun purchases were permanently recorded in california. this new gun law and others led to a last-minute rush on gun and ammunition sales at gun sales across the state. today is the first day millions of americans will receive medical insurance under the affordable care act. just hours before it went into effect, a denver charity was granted a reprieve and complying with the contraceptive mandate. our reporter tells us of the late order issued by a supreme

court justice. >> reporter: hours before ringing in the new year in times square, supreme court justice sonia sotomayor blocked the obama administration from forcing some religious affiliated groups to providing birth control under the affordable care act. the move fums after the nuns of colorado filed a lawsuit challenging the requirements because of religious beliefs. however, the administration argues churches are exempt and there are other ways to opt out as as religious nonprofit organization. this decision is important and could have a much broader reach. still pending, the case followed by a business who runs their business under christian principals. kathleen sebelius had this to say -- >> i'm thrilled we'll have millions of people with health security. it should be a great new year

for a lot of families across america. >> i'm sure there will be some issues. >> reporter: the contraception requirement along with other kinds of preventable care remains one of the most contentious parts of the law. the obama administration has until friday to respond to the decision. in washington, elizabeth prann, fox news. colorado today became the nation's first state to allow the legal sale of marijuana for recreational use. people stood in long lines this morning waiting for cannabis retailers to even their doors. under colorado's new law, customers must be at least 21 years old, in-state residents can purchase up to an ounce of cannabis. out of state residents have a limit of a quarter ounce. the first customer to purchase pot under the new law was an iraq war veteran who says he uses it to alleviate symptoms of post-traumatic stress

disorder. >> total $59.74. thank you very much. >> supporters say colorado will serve as a national model promoting the sensible use of reck rational pot. legalization critics warn that increased access will lead to a spike in drug abuse and crime. today marks the start of higher minimum wages in san jose and san francisco. workers in san francisco will get paid 10.74 up from 10.45. and then in san jose going up to 10.15. california's minimum wage will increase in july to $9 an hour. if you took b.a.r.t. this morning, you might have noticed it cost a little bit more. fares went up 5.2%. the board voted in february to continue its inflation-based fare increase program. riders will see an average increase of 19 cents per trip and the extra money will pay for new train cars, improvements at the hayward maintenance yard and a new

a 7-year-old girl is dead and her mother and younger brother are in the hospital. all three were hit last night as they walked in a san francisco crosswalk. ktvu's claudine wong has more on what happened and what the driver involved reportedly said in the moments following the crash. >> reporter: it happened here at polk and ellis right as brian tipton said he and his wife were leaving a nearby hotel. >> my wife, got out and walking down the street and the accident just occurred. the guy jumped out of his car and he said, i got the -- i had a green light. >> reporter: police say the light was green for both the driver and the victim. the driver was trying to turn

right from ellis onto polk. the victim, a mother, her 7- year-old daughter, and her 4- year-old son were trying to cross the street in the crosswalk. >> the vehicle is making a right-hand turn and the pedestrian is in the crosswalk, the vehicle is obligated to yield to pedestrians. >> reporter: police say the driver did not and all three pedestrians were hit. the 7-year-old girl died. the 4-year-old boy and his mother are still being treated at the hospital. the driver stopped and while drugs and alcohol are not believed to be factors in this crash he was eventually arrested on a charge of vehicular manslaughter. >> during the course of the investigators' interviews with the driver, there was enough evidence to develop to lead to that charge. >> reporter: police say the mother and son are both expected to survive but tipton said the tragedy is hard to comprehend. >> shocking the girl died. >> reporter: neither the driver nor the victim have been identified.

in san francisco, claudine wong, ktvu channel 2 news. a woman was killed in oak oakland in -- in oakland in a crash at 580. the chp says a white suv veered off the highway and flipped over near park boulevard. a woman who was a passenger died and the man driving the sufern was taken to the hospital -- suv was taken to the hospital with minor injuries. the cause of the crash is under investigation. two vallejo police officers are recovering from minor injuries after a suspected drunk driver hit their patrol car. police sent us a photo of the crash. you can see the suspect's damaged mini cooper alongside the patrol car. it happened around 2:15 this morning on georgia and monterey streets. the driver was arrested. and the chp is trying to determine the cause of a deadly new year's eve crash in a remote area of west marin county. a man was killed after the car he was in flipped and landed on its roof near tomales bay early yesterday evening. bystanders came to the rescue of the driver not seriously

hurt. a fiery explosion rocked a building in minneapolis, leaving at least 13 people injured. flames shot through the windows of the structure which houses apartments on the upper two floors. residents could be seen climbing down ladders to escape. emergency officials say injuries range from burns to trauma associated with jumps or falling from windows. there have been no reports of death but officials say they are still trying to determine if everyone had evacuated. an estimated 200,000 people showed up to see the big new year's eve fireworks show in san francisco. [ cheers ] >> the crowd started gathering along the embarcadero early to get a good spot for the display. the fireworks launched from barges near pier 14. there were plenty of police to make sure things stayed safe. there was also a zero-tolerance policy for drinking in public and open containers. ♪ dubai's new year's eve

fireworks show set a world record. 450,000 fireworks were launched in six minutes including some attached to the world's tallest building. more than 200 pyrotechnics planned the show over the past ten months. and in new york, the start of 2014 began with a massive cleanup for workers in times square. shortly after the ball dropped, cleanup crews got to work. a crew of about 40 people from the times square lines were ready with brooms and blowers to clear the confetti, streamers and other trash left behind. to give you an idea of what a messy job it is, last year the department of sanitation removed more than 50 tons of debris. you. you can bid fare well to 2013 with ktvu.com on the hot topics section. we have a year in review.

it includes popular stories, reviews, videos and slide shows. well, it's another nice day. we've had a lot of those. in fact, we had so many of them in 2013, we had the driest years ever for many. it was colder this morning. 20s, 30s. no doubt about it. very lazy skies. air quality continues to be not that good. some patchy fog came back to the coast. yesterday, it was the san jose peninsula. this morning mayly on the -- mainly on the coast. some of the bay area rainfall records and they are not ones we're proud of. usually we get a lot of rain. there was so many. i tried to take a couple of areas that usually get a lot of rain like occidental. they had 15.45 last year. they should have 56. kentfield had 7.80. and los gatos only had 3.24. it was bad for everybody. san francisco, as you know, the

driest. fresno, the driest. san francisco, the driest since 1877. speaking of information, usually december is wet. this december was the 6th driest own .039. the maximum temperature was right where it should be. they were running 2.2 below average. a soft 60 if you will. a few locations, fairfield, napa, 20s. 44 in reno. 48 in tahoe. 46 up in eureka. the big news continues to be the bitterly cold temperatures in the snow which is forming and the low coming out of the rockies. this is going to be probably a powerhouse system. probably late friday into saturday for much of the northeast. new york, boston, talking about winter storm warnings and blizzard warnings. be advised if you have to travel there late friday. for us a lot of high clouds. that's it. sunny, nice. very hazy.

a little warmer for some inland temperatures. not a lot. but a little bit. you look for a few low 60s, mid- 60s to upper 60s. these temperatures are above average. i guess we're used to that. it looks like they will continue to be above average. nice on the weekend but cooler. >> all right. still the same thing. >> thank you. james avery known as the fresh prince of bel air has died. he was a vietnam war veteran who began writing tv scripts and poetry for pbs after leaving the military. he appeared to many television shows and movies. most probable people probably know him as uncle will. he was 65. the cause of death has not been released. there is one bay area couple who gave more to charity than anyone else in 2013. the big donation from mark zuckerberg and his wife and the

it was a chilly start toot new year for 74 passengers stuck a ship in the ice in antarctica. ♪ >> as you can see, spirits are still holding up well among the passengers on board. the climate change research vessel they are on has not moved in a week since getting

stuck in unusually thick ice on christmas. several rescue attempts to reach the stranded passengers have failed. authorities say once the weather improves they plan to send in a rescue hadn'ter capable of picking up -- helicopter capable of picking up 12 passenger as at a time. the city of pasadena hosted the 125th annual tournament of roses parade. >> happy new year! [ cheers ] >> thousands of people lined up along colorado boulevard to get a good view of the iconic parade float. the parade featured over 50 floral floats. 20 marching bands and 16 equestrian units. one of the floats was inspired by a bay area mother. mateo's dream is based on a playground in concord. mateo lamitch was blind and lived a short life in a wheelchair. he was just 11 when he died. his dream was to create this playground in concord for

children of all abilities. his mother rode the mateo's dream float. you can watch the rose parade right now on our sister station. we'll continue to replay it until 7:00. and then comes the rosebowl. the cardinal playing in the game for the second state year. they face michigan state. this is the 100th rosebowl game pitting the pac 12 against the big 10. facebook billionaire mark zuckerberg and his wife are at the top of the list when it comes to charitable donations. the couple donated 18 million shares of facebook to the silicon valley community foundation this year. the shares are worth nearly $1 billion. nike chairman phil knight and his wife came in second. michael bloomberg is third and charles b. johnson is fourth. we're just getting word
