justice gorsuch, judge gorsuch was not compromised.merric so was chosen with any consultations totes not that there is merely equivalency. as my friend the majority leader has said, quote, i think we can stipulate that in the senat citt takes 60 votes on controversial matters. if anything is a controversial, important matter, it's at the selection of the supreme court. and senator mcconnell has v repeatedly stood for the need,, the ripeness, of 60 votes on important and controversial issues.0 if senator mcconnell wants to change his view on the 60 votes all of a sudden, and republicans decide to go along with him, it won't be because democrats started it because that's not true. it will be because democrats won't confirm any president trump nominated justice because that's not true. it will be because they choose to do so, and they will have to bear the unfortunate consequences.

we're going to confirm judge gorsuch this week. chris: secondly, do you have the eight democratic votes as we sit here today to avoid a filibuster? >> well, i don't think we know. there are democrats who have not yet announced their position. i assume, chris, during the course of the week what you asked me will become revealed by announcements of democrats who have not yet set out what they're going to do. chris: you say that he'll be confirmed one way or the other, so does that mean if you can't stop a filibuster, that you will go to the nuclear option and change the senate rules so that you can cut off debate with 51 votes and confirm him? >> look, what i'm telling you is that judge gorsuch is going to be confirmed. the way in which that occurs is in the hands of the democratic minority. and i think during the course of the week, we'll find out exactly how this will end. but it will end with his confirmation. chris: let me pick up on that. back in 2013 the democrats invoked the nuclear option to allow a simple majority, 51 votes,

as you know we're moving forward with the gorsuch nomination for the supreme court that should be wrapped up some time friday. it appears as if closure will not be invoked but we'll find out on thursday but either way we'll be moving toward confirming judge gorsuch on friday. when we get back, we'll be moving to the funding of the government. discussions are underway on a bipartisan basis. house and senate appropriators and we anticipate being able to finish that last week before the time runs out and so that's the

judge gorsuch is independent and he's fair. he's beyond qualified and he'll make a stellar addition to the supreme court. hardly anyone in the legal community seems to argue otherwise, and yet our democratic colleagues appeared poise to block this incredible nominee with the first successful partisan filibuster in american history. it would be a radical move, something completely unprecedented in the history of our senate, and out of all proportion to the imminently qualified judge who is actually before us, but then again this isn't really about the nominee anyway. the opposition to this particular nominee is more about the man that nominated him and the party he represents than the nominee himself. it's part of a much larger story, another extreme escalation in the left's never-ending drive to politicize the courts and the confirmation process. it's a fight they have waged for decades with a singular aim, securing raw power no matter the cost to the country or the institution. it underlies why this threatened filibuster canno

we have neil gorsuch on the supreme court. any of the statements or the addition of gorsuch going to change anything here to get his way basically? >> you know, the president has talked about this most recent ruling from san francisco from the judge who was unelected. well, of course, federal judges are nominated by presidents and confirmed by senates. and the most meaningful action that president trump could take if he's unhappy with rulings by judges is to fill the 121 federal and judicial vacancies around the country. over the course of the next 3 1/2 years or so he'll have an opportunity to do that. even some of the judges nominated by him have been suspicious of the travel ban. they have been using the president's statements against him. in ruling against the white house aims and the aims of the justice department. aside from appointing and filling judges for those federal judge vacancies, president trump might want to take the advice of some lawyers i talk toed which is to keep your mouth shut, stop tweeting about this i
