i want to ask you, chuck schumer had to say this. he says he wants to kavanaugh in these hearings to say that roe vs. wade was "correctly decided" and he should not be confirmed if not. is that a litmus test? is it fair? >> it's absolutely fair for senator schumer to think that angie wrote that. the process by which justices are selected is, by design, and this document, the constitution, a political process. presidents are allowed to pick nominees because they think they have a certain philosophy, a constitutional philosophy, and senators who disagree are allowed to vote against a candidate almost same grounds. every single justice who george washington dominated had been basically federalist, a supporter of the constitution. but when it comes up to the vote, half the country was on the other side and george washington picked only from his house. john adams picked only federalists, thomas jefferson nominated only jeffersonian democrats. it wasn't until abraham lincoln that a president picked someone from the opposite political party
