kershner, former federal prosecutor -- glenn, welcome. first off, glenn. the judge wants this trial to happen. if one thing is clear from the ruling so far, is this judges moving this along at a pretty fast clip. >> yeah, you know, the latest asked the defense team was for a one month continuance. and judge nichols ultimately said, you know what, i may give you a one day continuance. and then about an hour later, judge nichols took it back and said, no, we're going to opening statements today. so we are now in the thick of steve bannon's criminal contempt of congress trial. >> so what went down today? >> opening statements. which were actually pretty interesting. the prosecutor, assistant u. s. attorney amanda von, did a really nice job. she presented a linear, logical, and perhaps most importantly layman friendly opening statement to the jury. it almost had a civics class feel to it. which i think was appropriate. because she needed to explain to the jurors, they don't all necessarily know how congress functions. what's the house of repr

joining us now, glenn kershner, former federal prosecutor, and an msnbc legal analyst. also with us jill wine-banks she's an msnbc contributor. glenn, you are in the courtroom today. what were the highlights of jury selection for steve bannon? >> well, lawrence, one of the overarching observations is i don't recall seeing jury selection where there was quite so universal sentiment that the defendant had done something horribly wrong and that the jurors were comfortable expressing their negative impressions of steve bannon. i would put the jurors into basically three categories: the first category where the people who said things that were just sort of instantly disqualifying. i believe he's guilty, i have such strong feelings about what he did, that i cannot set them aside and agree to sit fairly and impartially as a juror in this case. those folks were excused by the judge pretty quickly. the second bench of jurors were people who had heard what happened on january 6th, maybe they followed some of the public hearings. they kind of knew who steve bannon was, and they mi

joining us now is glenn kershner, former prosecutor and msnbc legal analyst. he was in the courtroom, and glenn, two witnesses. one a council to the january six committee, saying that this was our subpoena, here is the date that it says on the subpoena. he was supposed to show up. and then fbi witness. what did the fbi witness accomplish for the prosecution? >> he introduced to the jury some of steve bannon's posts on a platform called getter, where he was bragging and boasting about willfully defying the congressional subpoenas. that is a little bit of icing on the case. nobody can accuse these prosecutors of over trying the case, i think they tried it brilliantly. proving steve bannon's guilt beyond a reasonable doubt, with just two witnesses. >> and so the defense case tomorrow, the question in all trials, will the defendant testify? >> lawrence, i think there was one thing that all americans can agree on. steve bannon loves to run his mouth. not just on his podcast, but he has been putting on an absurd little dog and pony show every day after trial, on the
