Attorney Docket No. 7451.0001-18000
Intertrust Ref. No.: IT-5.2.1(U.S.)

In Interference No. 105,142, on November 17, 2004, the APJ granted Benson's
preliminary motion to replace count 3 with count 4. See Exhibit A, pp. 11, 16. On
December 28, 2005, the Board mailed its Decision on Priority holding that Ginter had
proved prior conception of the subject matter of all counts, but that Ginter had not
proved reasonable diligence during the critical period running between February 1,
1995, and February 13, 1995. See Exhibit B, p. 144. In keeping with this Decision, on
January 5, 2006, the Board entered judgment against Ginter on all counts. See Exhibit
C. On February 5, 2006, Ginter filed a Request for Rehearing, asking the Board to
reconsider its Final Judgment. Benson's Response to Ginter's Request is due on
February 28, 2006, with Ginter's Reply due on March 3, 2006.

In Interference No. 105,193, the Board entered Final Judgment on June 8, 2005,
awarding priority of the sole count to Ginter (Intertrust). See Exhibit D.

If there is any fee due in connection with the filing of this Statement, please
charge the fee to our Deposit Account No. 06-0916
