The following is an examiner's statement of reasons for allowance: 
The prior art fails to teach or suggest a structure/method of an epitaxial base 
layer in a bipolar device particularly the top layer of silicon is laterally stepped back

from the bottom layer of silicon nitride to form a stepped seed layer as set forth in 
combination of claims 1 or 10 or 14. 

The remaining claims are allowable for at least the same reason. 

Any comments considered necessary by applicant must be submitted no later than 
the payment of the Issue fee and, to avoid processing delays, should preferably 
accompany the issue fee. Such submissions should be clearly labeled "Comments on 
Statement of Reasons for Allowance." 

Conclusion 

7. The prior art made of record and not relied upon is considered pertinent to 
applicant's disclosure: 

US-6,384,469 teaches related subject matter such as a structure/method of an 
epitaxial base layer in a bipolar device with a field isolation oxide region, an active 
silicon region, silicon nitride/silicon stack, Si/SiGe/Si stack layer yet does not 
discloses the structure/method of the top layer of silicon is laterally stepped back 
from the bottom layer of silicon nitride to form a stepped seed layer as set forth in 
combination of claims 1 or 10 or 14.
