1 . An examiner's amendment to the record appears below. Should the changes and/or 
additions be unacceptable to applicant, an amendment may be filed as provided by 37 CFR 
1.312. To ensure consideration of such an amendment, it MUST be submitted no later than the 
payment of the issue fee. 

2. Authorization for this examiner's amendment was given in a telephone interview with 
Benjamin J. Hauptman on September 26, 2005. 

The application has been amended as follows: 
In the claim: 

a) Cancel non-elected claims 8 - 1 1, 14 - 17 and 20 - 23. 

b) Claim 1, line 5, after "structure" delete [and] insert --, said at least one 
electrode being-.

4. The following is an examiner's statement of reasons for allowance:

The prior art of record does not teach or suggest, either singularly or in combination, at 
least a first chip on a second chip; at least one electrode for cooperating with moveable structure 
on the first chip that is disposed on the second chip; a spacer ring surrounding the moveable 
structures that is disposed between the first chip and the second chip; a plurality of bumps on 
pads of the first chip; first surfaces of leads are connected to the bumps; and an encapsulant 
encapsulating everything except the second surface of the leads. Glenn et al. (U. S. Pat. No. 
6,522,015) teaches a first chip on a second chip and a spacer ring surrounding the moveable 
structures and disposed between the first chip and the second chip. Hsuan et al. (U. S. Pat. No. 
6,239,366) teaches bumps on pads of the first chip and a plurality of leads connected to the 
bumps. However, Glenn et al. and Hsuan et al. do not teach bumps on pads of the first chip 
having moveable structure and the second surface of the leads are exposed out of the encapsulant 
as set forth in claim 1 .
